Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and Mappey (“Mappey,” “we,” “us,” or “our”). They apply to the Mappey iOS app, mappey.app, and related services (together, the “Service”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Who may use Mappey

You must be at least 13 years old and legally able to enter into these Terms. If the law where you live requires consent from a parent or guardian, you may use the Service only with that consent. If you use Mappey for an organisation, you confirm that you have authority to bind that organisation to these Terms.

3. The Service

Mappey helps you save places, organise trip lists, import place information, share list snapshots, and receive optional nearby alerts. We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

Some features may be labelled preview, beta, or early access. They may be incomplete, change without notice, or be withdrawn.

4. Your content and shared links

You keep ownership of content you add to Mappey, including list names, notes, and saved places (“Your Content”). You give us a limited, worldwide, non-exclusive licence to host, copy, process, and display Your Content only as needed to operate, secure, and improve the Service.

When you create a sharing link, anyone with that link can view the shared snapshot and import an independent copy. Do not put confidential, sensitive, or unlawful information in a shared list. You are responsible for Your Content, the people you send links to, and ensuring you have the rights needed to share that content.

5. Imports and third-party services

Mappey can help you import or link to information from services such as Apple Maps, Google Maps, and TikTok. Those services are operated by others and are governed by their own terms and policies. Mappey is not endorsed by, responsible for, or in control of third-party services, their content, or their availability.

You may import only information you are authorised to access and use. Place details can be incomplete, outdated, or inaccurate, so verify important information with the venue or original source.

6. Location and travel safety

Mappey is a planning and discovery tool, not an emergency service, navigation system, or source of safety-critical information. Nearby alerts, distances, opening details, and map results may be delayed or incorrect. Stay aware of your surroundings, follow local laws and signs, and use an appropriate navigation service when travelling. Never rely on Mappey where an error could cause injury, loss, or danger.

7. Acceptable use

You agree not to:

• use the Service unlawfully or infringe another person’s rights;
• upload or share harmful, deceptive, abusive, or privacy-invasive content;
• probe, disrupt, overload, or bypass the Service’s security or access controls;
• use automated means to scrape or extract data except with our written permission;
• reverse engineer the Service except where the law expressly permits it; or
• use Mappey to build a competing database or service.

8. Mappey’s rights

The Service, including its software, design, branding, and original content, belongs to Mappey or its licensors and is protected by intellectual-property laws. Except for the limited licence above, these Terms do not give you rights in the Service or our marks.

If you send suggestions or feedback, you allow us to use them without restriction or compensation, but you do not have to provide feedback.

9. Availability and changes

We may add, change, suspend, or discontinue parts of the Service. We do not promise that the Service will always be available, error-free, or compatible with every device. You are responsible for keeping copies of content you need and for maintaining a compatible device, network connection, and operating system.

10. Suspension and termination

You may stop using Mappey at any time. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk for the Service or others, or if we are required to do so by law. Where reasonable, we will provide notice and an opportunity to address the issue.

Provisions that by their nature should continue after termination—including ownership, disclaimers, liability limits, and dispute provisions—will continue to apply.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Mappey disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, Mappey and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Mappey’s total liability for claims relating to the Service will not exceed CAD $100.

These limits do not apply where they are prohibited by law, including liability that cannot legally be limited. Nothing in these Terms affects mandatory consumer rights you may have.

13. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have jurisdiction, unless the mandatory law where you live gives you the right to bring a claim elsewhere.

14. App Store terms

If you download Mappey through Apple’s App Store, your use is also subject to Apple’s applicable terms. Apple is not responsible for providing maintenance or support for Mappey, except as required by law.

15. Changes to these Terms

We may update these Terms as the Service changes. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice when required. Your continued use after the updated Terms take effect means you accept them.

16. General

If any provision of these Terms is unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganisation, financing, merger, acquisition, or sale of the Service. These Terms and the Privacy Policy are the entire agreement between you and Mappey about the Service.
